Terms of Service
Version 2026-10-30.1, effective 31 October 2026.
These terms apply to the websites usespitfire.com and spitfire.tr (the "Sites"), the customer account, the free license key and the purchase of Spitfire licenses. They are offered by Albiferro Yazılım ve Sistem Limited Şirketi (Albiferro Software & System Limited Company) ("we", "us"), Atakent Mah. 1472. Sok. Eda Apt. No:5 D:3 Elvankent, Etimesgut, Ankara, Türkiye, MERSİS No 0050147497700001, tax number 0501474977 (Etimesgut, Ankara, Türkiye tax office), contact@usespitfire.com.
1. What these terms cover
- Using the Sites, the customer account and the forms on them.
- Downloading and using the Spitfire software: the End User License Agreement (usespitfire.com/eula) sets the license terms of the software itself, for the free edition and the paid plans.
- Buying a license: an order is concluded on the Distance Sales Agreement and the Preliminary Information you accept at checkout. Where these terms and that agreement say different things about an order, the agreement prevails.
2. The product
Spitfire is load testing software that you install and run on your own servers (Docker, Kubernetes or Windows). We do not host it, operate it or store your test data, and the license key is verified offline. What each plan includes and its limits are shown on usespitfire.com/buy at the time of purchase and are written in the license key.
3. Accounts
You may open a customer account with your e-mail address; there is no password, you sign in with a link or code sent to your e-mail or with Google, GitHub or Microsoft. Keep access to your mailbox secure: whoever can read it can sign in. You can delete your account at any time in its settings. We may close an account that is used to break these terms or the law, and tell you why.
4. Orders, prices and taxes
- Prices are shown in the currency of the page (US dollars on usespitfire.com, Turkish lira on spitfire.tr). The checkout shows the amount you pay before you confirm.
- We are established in Türkiye. Sales to buyers outside Türkiye are exempt from Turkish VAT. Any VAT, sales tax or similar tax the law of your country puts on the buyer (for example, reverse charge for a business in the EU) is yours to account for.
- A business in the European Union gives its VAT ID, which we check with the EU's VIES service. Purchase order (PO) numbers and a separate invoice e-mail address can be given at checkout and appear on the invoice.
- Payment is by card on the payment page of PayTR, a licensed payment institution, or by bank transfer. Card details do not reach us. Nothing renews or is charged on its own: every payment is one you make for that order.
- The license key is e-mailed after the payment is confirmed. Refunds and withdrawal: usespitfire.com/refunds-and-withdrawal.
5. Acceptable use
You may use the Sites and the software only lawfully. In particular you must not:
- run load tests against systems you do not own or are not authorised to test, or use the software to disrupt, overload or attack any system;
- try to break into the Sites, the shop or other customers' accounts, or put an unreasonable load on them;
- circumvent the software's license or protection mechanisms, or share, sell or publish license keys;
- submit false order or invoice details.
You decide what is tested, when and with what load; you are responsible for the effect of your tests on the systems tested.
6. Intellectual property
The software, the Sites, their content, the Spitfire name and logo belong to us or our licensors. The license grants rights of use only as the EULA says; it transfers no ownership. Open-source components included in the software are under their own licenses, listed with the software.
7. Feedback
If you send us suggestions or feedback, we may use them to improve the product without owing you anything. We publish feedback with your name only if you ticked the form's box for it.
8. Availability of the Sites
We try to keep the Sites available but do not promise uninterrupted service. As the software runs on your servers and the key is checked offline, an outage of the Sites does not stop an installed Spitfire.
9. Warranty and liability
- The free edition is provided as it is, without warranty.
- For paid licenses, the rights in the Distance Sales Agreement apply (a working key, or a refund if a defect cannot be fixed) and the statutory rights a consumer has under the law of their country are not limited.
- For business customers, to the extent the law allows, our total liability arising from a license is limited to the amount paid for that license in the 12 months before the event, and we are not liable for indirect damage, lost profit, lost data or the cost of outages that tests cause on the systems tested.
- These limits do not apply to damage caused intentionally or by gross negligence, to death or personal injury, or where the law does not allow them.
10. Personal data
How we process personal data is explained in the Privacy notice (usespitfire.com/privacy-notice) and, for people in the European Economic Area, the United Kingdom and Switzerland, in the GDPR privacy notice (usespitfire.com/gdpr-privacy-notice). The software you install processes your test data on your own servers; see the Data processing statement (usespitfire.com/data-processing-agreement).
11. Changes
We may change these terms for the future; the version and date above change with them and a material change is announced on the Sites. An order stays on the terms accepted when it was placed.
12. Law and disputes
These terms are governed by the law of the Republic of Türkiye. For business customers the courts and enforcement offices of Ankara have jurisdiction. A consumer keeps the protection of the mandatory rules of the country where they live and may bring a claim in its courts; consumers in Türkiye may apply to the consumer arbitration committees and courts as the Distance Sales Agreement says.
