End User License Agreement (EULA)
Version 2026-10-30.1, effective 31 October 2026.
This agreement is between Albiferro Yazılım ve Sistem Limited Şirketi (Albiferro Software & System Limited Company) ("we") and the person or organisation that installs or uses the Spitfire software ("you"). By installing or using Spitfire you accept it. If you use Spitfire for an organisation, you accept it for that organisation.
1. Editions
- Free edition: usable without a key or with a free key from usespitfire.com/free-key, within the free edition's limits shown on usespitfire.com/buy, for any lawful purpose.
- Paid plans: a signed license key bought on usespitfire.com or spitfire.tr turns on the plan's features and limits for the term written in the key. The order is also governed by the Distance Sales Agreement accepted at checkout.
2. License grant
We grant you a non-exclusive, non-transferable license to install and use Spitfire, for the term and within the limits of your license key (the free edition: without a time limit), in one Spitfire installation with its runners. An Enterprise license covers the number of production and test installations stated in the order. You may make backups and use offline installation bundles for the licensed installations.
3. Restrictions
You may not:
- transfer, sell, rent, sublicense or publish a license key, or use one key in more installations than it allows;
- remove, bypass or tamper with the license check, the key's signature or other protection mechanisms;
- reverse engineer, decompile or disassemble the software, except as far as mandatory law allows it despite this restriction;
- use the software to test systems you do not own or are not authorised to test, or to disrupt or attack any system;
- offer Spitfire itself to third parties as a hosted service without a separate written agreement with us.
Open-source components keep their own licenses; nothing here restricts rights those licenses give you.
4. Your data
Spitfire runs on your servers and stores your tests, results, credentials and logs in your own database. We have no access to them. The license key is verified offline. The software contacts us only:
- for the update check: it downloads the public, signed release list (spitfire.tr; it can be turned off with SPITFIRE_UPDATE_CHECK=off or pointed to an internal mirror); the request carries no data about you or your tests;
- for the health summary, only if an installation admin turns it on (off by default): version, platform, error kinds and counts, runner counts, under a random id; never test content, target addresses, user names or IP addresses.
You are responsible for your installation's security, backups and the data you put into it.
5. Updates and support
New releases are published on usespitfire.com. Paid plans include e-mail support with the response time stated on the plan page; Enterprise support is as stated in the order. A response time is not a resolution time.
6. Term and termination
A paid license ends at the end of its term; 14 days of grace follow, then the installation runs within the free edition's limits and none of your data is deleted. If you break sections 2 or 3 and do not stop after our notice, we may end your license; you then stop using the key.
7. Warranty
We warrant for the term of a paid license that the software substantially provides the features described for its plan; if it does not and we cannot fix it, we refund the amount paid as the Distance Sales Agreement says. Otherwise, and for the free edition, the software is provided "as is", to the extent the law allows. Load tests put real load on real systems: you decide what to test and with what load.
8. Liability
To the extent the law allows, our total liability under this agreement is limited to the amount you paid for the license in the 12 months before the event (the free edition: zero), and we are not liable for indirect or consequential damage, lost profit, lost data or the cost of outages that tests cause. These limits do not apply to damage caused intentionally or by gross negligence, to death or personal injury, or to a consumer's mandatory statutory rights.
9. Export and sanctions
You will not use or export the software in breach of applicable export control or sanctions laws.
10. Law
This agreement is governed by the law of the Republic of Türkiye; the courts of Ankara have jurisdiction for business customers. A consumer keeps the protection of the mandatory law of the country where they live.
